TEMPERAMENTAL DIFFERENCE NO GROUND FOR DIVORCE: BOMBAY HIGH COURT

The Bombay High Court recently said that temperamental differences between spouses could qualify as “normal wear and tear of marriage life” but cannot become grounds for divorce.

Since marriage is a whole collection of relationships and responsibilities that comes along with the tied knot of marriage, that both the partners have to carry together. As responsibilities, worries, anxieties and stress do result in temperament , which can also be influenced by several other factors concerning family and related issues. But that just happens in a family and its a part of life.

So , it seems irrelevant to file a divorce on the basis of temperamental differences between spouses. It can be corrected and hence considering it as an aspect during divorce will be right,but giving in due attention for divorce will be injustice. And temperamental differences should never come across in any couples married life. The divorce leaves a bad impact on the people of family and children especially. The increasing rates of divorces and its related cases have affected our culture and generation to an impactful level,changing the beliefs and thoughts to deal with problems,encouraging more divorces to take place.

The Bombay High Court has made a righteous decision by not considering temperamental difference as ground for divorce. The court ordered this while discussing an appeal filed by a man, seeking divorce from his wife due to her quarrelsome nature and demanding for a separate home.

Justice prevails as the order was made.
